Instructions on withdrawal

Consumers have the right of withdrawal set out below. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, business or profession.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods. In the case of a contract relating to multiple goods ordered by you in one order and delivered separately, the withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good.

You may use the model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us (Peppersack und Frey Sports GbR, Westheck 13, 59427 Unna, Germany) without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The following information does not form part of the instructions on withdrawal. It merely explains them and does not restrict your statutory rights.

Calculating the withdrawal period

Section 187 (1) of the German Civil Code (Bürgerliches Gesetzbuch, BGB) applies to the start of the period: the day on which you took possession of the goods is not counted. The period therefore begins on the following day and ends, pursuant to Section 188 (1) BGB, at the end of the fourteenth day. Example: if you receive the goods on a Monday, the period begins on Tuesday and ends at the end of the Monday of the week after next.

Pursuant to Section 356 (3) BGB, the withdrawal period does not begin before we have properly informed you of your right of withdrawal.

Ways in which you can withdraw

You can declare your withdrawal informally by e-mail, by letter or by telephone. Section 355 (1) BGB does not require any particular form; any unequivocal statement is sufficient, and all channels are equally valid.

No conditions attached to the exercise of the right of withdrawal

• No prior notification or authorisation of the return is required.
• The right of withdrawal also applies to reduced items and to sale items.
• Returning the goods in their original packaging and the presence of labels are not a condition for your withdrawal to be effective. We only recommend packaging that is safe for transport in order to avoid damage on the way back to us.
• You do not have to give reasons for your withdrawal (Section 355 (1) sentence 4 BGB).

Compensation for diminished value

You may examine the goods as you could in a shop – in particular, you may try them on. Compensation for diminished value under Section 357a (1) BGB only comes into consideration in so far as a diminished value results from handling the goods that was not necessary to establish their nature, characteristics and functioning – for example wearing the shoes outdoors or on the pitch.

Who bears the risk on the way back to us

Pursuant to Section 355 (3) sentence 4 BGB, we bear the risk of loss of or damage to the goods on their way back to us. You bear only the direct cost of returning the goods, that is to say the postage. Please keep your proof of posting so that you can demonstrate that you sent the goods back in good time.
